This preliminary information form has been prepared to inform you about the order you place in accordance with the Law on the Protection of Consumers and the Regulation on Distance Contracts.

The purpose of this form is to ensure that the Buyer is informed, in accordance with Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts, about the sale and delivery of the product(s) whose specifications and sale price are stated below, and—if the Buyer qualifies as a consumer—the right of withdrawal, as well as BitterColors’ information.

By accepting this preliminary information form, the Buyer acknowledges, represents, and undertakes that if the Buyer confirms the order subject to the contract, the Buyer will be obliged to pay the order amount and, if applicable, additional fees specified such as shipping fees, installation and service fees, taxes, and similar charges.

As a Member/Visitor, please read this information form carefully before using BitterColors’ goods and/or services. By using the goods and/or services set out in this preliminary information form, you agree to be bound by these terms.

As a Member/Visitor, by placing an order, the Buyer acknowledges and declares that the Buyer has read and understood all preliminary information, has provided the required confirmation electronically, and will assume a payment obligation, including but not limited to: the basic characteristics and specifications of the product subject to the contract; seller and intermediary service provider information; contact details; product sale price; delivery costs; payment method; delivery period and delivery-related information; complaint resolution methods; and information on the exercise of the right of withdrawal and return.

4. PAYMENT AND DELIVERY INFORMATION:

a) PAYMENT:

Payment via Virtual POS by Bank or Credit Card

The section above contains information on how many installments the order total will be paid in to the bank you work with. Your bank may organize various campaigns and may offer more installments than the installment options we provide, or services such as installment deferral. Such campaigns are under the responsibility of your bank; we bear no responsibility if the bank does not apply them. Your bank will reflect the order total on your credit card statement by dividing it into the number of installments. The bank may not distribute installment amounts equally across months by taking rounding differences into account. Your detailed payment plan is created by your bank.

If the Buyer prefers to pay by money transfer/EFT, the bank IBAN information available on https://bittercolors.com/ is shared via the membership account. After the Buyer completes the money transfer/EFT payment, the order will be approved once the payment reaches BitterColors’ bank account. The Buyer must write the order number in the description field of the transfer.

b) DELIVERY INFORMATION:

Except for all exceptions stated on the website, the shipping and/or transportation fee, which is the cost of dispatching the Product, shall be paid by the Buyer. The shipping fee is ……….. TL, and these amounts are added to the order total. It is not included in the product price. Delivery will be made via the contracted cargo company to the Buyer’s address stated above. Even if the Buyer is not present at the address at the time of delivery, the Seller shall be deemed to have performed its obligation fully and properly. Therefore, BitterColors shall not be responsible for any losses and expenses arising from the Buyer’s late receipt of the product and/or failure to receive it.

Delivery cannot be made to islands, overseas locations, or abroad. When the Product(s) to be shipped are handed over to the cargo company, the relevant cargo company and tracking number will be shared with the Buyer via SMS and/or email. The rules regarding the delivery process are determined by the cargo company.

For products other than those that are not readily available in stock and are prepared upon the Buyer’s request—i.e., products for which production starts after the Buyer’s order due to lack of stock—delivery times will be within the periods determined by the applicable legislation. In sales of goods (except for contracts relating to goods prepared in line with the consumer’s request or personal needs), this period may not exceed thirty (30) days in any case.

5. RIGHT OF WITHDRAWAL:

a) If the Buyer is a Consumer within the scope of Law No. 6502:

In distance contracts for the sale of goods, the Buyer may exercise the right of withdrawal within fourteen (14) days by notifying the Seller, without assuming any legal or criminal liability and without giving any reason, by rejecting the goods and withdrawing from the contract. The Buyer may also exercise the right of withdrawal during the period until the delivery of the goods. During the withdrawal period, the Buyer may use the goods only to the extent required by an ordinary inspection, in accordance with their operation, technical characteristics, and instructions for use.

b) Determination of the Withdrawal Period:

For goods that are the subject of a single order but delivered separately, the day on which the Buyer or a third party designated by the Buyer receives the last good,
For goods consisting of more than one part, the day on which the Buyer or a third party designated by the Buyer receives the last part,
For contracts where delivery of goods and performance of services are made together, the provisions regarding the right of withdrawal relating to delivery of goods shall apply.

c) How to Exercise the Right of Withdrawal:

To exercise the right of withdrawal, the Buyer must notify BitterColors within the fourteen (14) day period. The withdrawal notification can be made via https://bittercolors.com/. BitterColors will promptly send the Buyer confirmation that the withdrawal request submitted through the website has been received. The Buyer must fill out the return request form on the relevant page and send the goods back to BitterColors within fourteen (14) days from the notification date.

d) Carrier for Returns:

The carrier stipulated within the scope of the right of withdrawal is the RELEVANT CARGO OR TRANSPORTATION COMPANY, and details regarding return shipment are explained on the membership page at https://bittercolors.com/. If the right of withdrawal is not used within the scope and details stipulated, the return delivery cost shall be borne by the Buyer.

e) Refund:

BitterColors is obliged to refund all payments collected, including delivery costs (if any) for the delivery of the goods to the Buyer, within fourteen (14) days from the date on which it receives the Buyer’s notice of withdrawal. The Buyer acknowledges, represents, and undertakes that the average period for the refunded amount to be reflected in the Buyer’s account by the bank may take 2 to 3 weeks, and that the reflection of the amount to the Buyer’s accounts after it is refunded to the bank is entirely related to the bank’s processing period; therefore, the Buyer cannot hold BitterColors responsible for possible delays.

f) In Case the Buyer Exercises This Right:

The invoice of the product delivered to the Buyer or a third party (If the invoice of the product to be returned is issued to a corporate entity, a return invoice issued by the institution must be sent together with the return. Returns of orders invoiced to institutions cannot be completed unless a RETURN INVOICE is issued.),
Sending the return form or completing the return request form via https://bittercolors.com/,
Returning the products in full and undamaged condition, together with the box, packaging, and any standard accessories.

If there is a decrease in the value of the goods due to the Buyer’s fault or if return becomes impossible, the Buyer shall be obliged to compensate BitterColors for its damages.

6. PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:

PERSONALIZED PRODUCTS: Contracts relating to goods prepared in line with the Buyer’s requests or personal needs. Custom size/fabric/color change/creating a set with individual products outside the standard set,
Products whose protective elements such as packaging, tape, seal, or wrapping have been opened after delivery,
HYGIENE PRODUCTS: Contracts relating to goods that are not suitable for return in terms of health and hygiene. Due to their nature, home textile and bedding products including, but not limited to, duvet covers, mattress protectors, and pillows,
Products used beyond an ordinary inspection.

7. SETTLEMENT OF DISPUTES:

The Buyer may submit complaints and objections, within the monetary limits specified in the relevant legislation, to the consumer arbitration committee or consumer court located in the place of residence of the Buyer or where the consumer transaction was carried out.

In disputes arising from the Distance Sales Contract; Provincial or District Consumer Arbitration Committees are authorized up to the value announced each year by the Ministry of Trade. For disputes exceeding this value, Consumer Courts shall have jurisdiction, provided that the condition of applying to a mediator before filing a lawsuit is fulfilled in accordance with Law No. 6502 on the Protection of Consumers.

Monetary limit information is as follows:

Effective as of 01/01/2026, the value for applications to consumer arbitration committees for the year 2026 is: 186,000 TL.
